Mindful Solutions LLC · TailoredPlate
Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") are a legal agreement between you and Mindful Solutions LLC ("Mindful Solutions," "we," "us," or "our") governing your use of the TailoredPlate mobile application and related services (together, the "Services").
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
When you accept these Terms in the App, we record which version you accepted and when. We retain acceptance records for as long as needed to demonstrate legal compliance and to establish or defend legal claims, including after you delete your account.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18 or older and are capable of entering into a binding agreement. When you set up your profile, the App asks you to confirm that you are 18 or older; accounts that cannot confirm this are removed.
3. The Services
The Services are offered for use in the United States. TailoredPlate is a recipe application that uses artificial intelligence to generate recipes tailored to your stated ingredients, dietary needs, exclusions, and preferences. You can provide these inputs in several ways, including typed or spoken free-text descriptions of the meal you want. The Services require an account and may offer paid subscription plans (see Section 6).
We may modify, suspend, or discontinue any part of the Services at any time. We may also update the Services and these Terms as the App evolves.
4. Accounts
To use the Services, you must create an account using email and password, or by signing in with Apple or Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current.
You may delete your account at any time from within the App. Account deletion is described in our Privacy Policy.
5. AI-Generated Content — Important Disclaimers
Recipes and related content in the App are generated by artificial intelligence and are provided for general informational purposes only. AI-generated content may contain errors, inaccuracies, or omissions. You are responsible for using your own judgment before preparing or consuming any recipe.
5.1 No Medical or Professional Advice
The Services do not provide medical, nutritional, health, or other professional advice. Recipes, ingredient information, and any nutritional or dietary content are not a substitute for advice from a qualified physician, registered dietitian, or other healthcare professional. Always consult a qualified professional regarding your health, diet, allergies, and any medical condition. Never disregard professional medical advice or delay seeking it because of something you read in the App.
5.2 Allergens and Food Safety — Read Carefully
The App's ingredient-exclusion and allergen features are tools to assist you, but they are not guaranteed to be complete or error-free, and you must not rely on them as your sole safeguard against allergens or other harmful ingredients. AI-generated recipes may contain, omit, or mislabel ingredients, including allergens.
If you have a food allergy, intolerance, or sensitivity — including any condition that can cause anaphylaxis or other serious reactions — you must independently verify every ingredient before purchasing, preparing, or consuming any food. Do not rely on the App to keep you safe from allergens. We are not responsible for allergic reactions or other adverse effects resulting from your use of the Services.
You are responsible for safe food handling, preparation, cooking temperatures, and storage.
The App does not replace: reading the actual ingredient labels of the products you buy, every time you buy them (ingredient formulations change without notice); verifying every ingredient at the point of purchase and again while preparing food; the guidance of your physician, allergist, or dietitian for your specific condition; or your own emergency preparedness and reaction protocols. The App is a planning tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.
Recipe images are decorative. They are generated separately from the recipe and may show ingredients the recipe does not contain, or omit ones it does. Never use the image to judge whether a dish is safe for you — the ingredient list is the only part of a recipe that reflects your exclusions.
Your inputs govern what the App can do. The App's exclusion features can only act on the restrictions you enter and keep current. If your dietary profile is incomplete or out of date, recipes will not reflect your actual needs. You are responsible for the accuracy and completeness of the information you provide.
Turning protection off. The App may offer a control that lets you request a batch of recipes without applying your exclusions (labeled, for example, “Ignore my exclusions for this batch”). Turning it on requires an explicit confirmation that names foods you have excluded, it applies only to that batch on that screen, it turns back on automatically when you leave, and recipes generated with it are permanently labeled (for example, “MADE WITHOUT EXCLUSIONS”). If you use this control, you are choosing to receive recipes that may include foods you have excluded, including your allergens, and you accept full responsibility for that choice. Recipes generated this way are not re-checked against your exclusions, including if you later modify them.
5.3 Dietary and Health Conditions
If you have a medical or dietary condition (including but not limited to alpha-gal syndrome, FODMAP sensitivity, histamine intolerance, diabetes, or any allergy), consult your healthcare provider before relying on any recipe or dietary feature in the App.
5.4 Eating Disorders and Wellbeing
The App is not designed to diagnose, treat, or manage eating disorders or any related condition. If you or someone you know is struggling with disordered eating, support is available.
In the United States, you can contact the National Alliance for Eating Disorders helpline at 1-866-662-1235.
6. Subscriptions and Payments
The Services may offer free and paid subscription plans, including plans with limits on the number of recipes you can receive.
- Purchases are processed through the Apple App Store or Google Play, subject to their terms. Subscription status is managed through our subscription provider.
- Billing, renewal, and cancellation are governed by the app store through which you subscribed. Subscriptions generally renew automatically unless cancelled, and you can manage or cancel them in your app store account settings.
- Plan limits. Paid plans include a defined number of recipes per billing period, as shown for the plan you select. A single generate action can deliver more than one recipe, and each delivered recipe counts toward your plan's limit. Modifying a recipe counts as one recipe against your plan's limit, on the same terms as generating one; a modification that cannot be delivered safely is not counted. Paid-plan limits reset with your subscription's billing cycle. The free tier includes a fixed number of recipes for the lifetime of your account, as shown in the App; the free allowance does not reset.
- Refunds are handled by the applicable app store in accordance with its policies.
7. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Services, other accounts, or our systems;
- Interfere with or disrupt the Services;
- Reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by law;
- Use the Services to generate content that is unlawful or harmful;
- Resell, redistribute, or commercially exploit the Services or generated content except as expressly permitted.
In addition, you may not: access the Services or any TailoredPlate endpoint by automated means (including scraping, crawling, or bulk requests) except as the App itself does on your behalf; abuse, probe, or enumerate recipe-sharing links or the sharing service; reverse engineer, decompile, or disassemble any part of the Services except where that restriction is prohibited by law; use the Services to build, train, or benchmark a competing product; or resell or redistribute Service output at scale.
8. Intellectual Property
The App, including its software, design, and branding (including the names "TailoredPlate" and "Mindful Solutions"), is owned by Mindful Solutions LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
Recipes and other content generated for you are yours to use for any personal purpose. You grant Mindful Solutions LLC the right to store, reproduce, adapt, and reuse generated recipes, including serving them to other users, and you acknowledge that AI-generated content is not exclusive to you — similar or identical recipes may be generated for or served to others.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any recipe or content will be accurate, complete, safe, or suitable for your needs.
10. Release, Limitation of Liability, and Cap
10.1 Release and Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND AGREE NOT TO SUE MINDFUL SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS FROM AND FOR ANY AND ALL CLAIMS, DEMANDS, DAMAGES, AND CAUSES OF ACTION OF EVERY KIND, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, INCLUDING CLAIMS ARISING FROM OUR OWN NEGLIGENCE. YOU UNDERSTAND THAT YOU ARE GIVING UP THE RIGHT TO BRING A LAWSUIT AGAINST US BASED ON OUR NEGLIGENCE.
This release does not apply to gross negligence, willful or wanton misconduct, or any other claim that cannot be released under applicable law, and nothing in these Terms attempts to release such claims.
10.2 Exclusion of Certain Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDFUL SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO FOOD PREPARATION, ALLERGIC REACTIONS, OR RELIANCE ON AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Aggregate Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF MINDFUL SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
If a court holds any part of this Section 10 unenforceable, the remaining parts stay in effect (see Section 15.1), and the unenforceable part is limited or severed only to the minimum extent required.
11. Indemnification
You agree to indemnify and hold harmless Mindful Solutions LLC from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or for any other reason permitted by law. You may stop using the Services and delete your account at any time.
13. Governing Law, Arbitration, and Disputes
13.1 Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles.
13.2 Informal Resolution First
Before starting any arbitration or lawsuit, you agree to send us a written notice of the dispute describing the claim, the facts, and the relief you seek, and to give us 60 days to try to resolve it with you informally. Notices go to the contact address in Section 17. This step is a precondition to filing.
13.3 Binding Individual Arbitration
EXCEPT FOR THE CLAIMS DESCRIBED IN SECTION 13.4, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules and its Mass Arbitration Supplementary Rules, rather than in court. We will pay the arbitration fees allocated to us under those rules. Either party may instead bring an individual claim in small-claims court if it qualifies.
13.4 What Is Not Arbitrated
Claims for personal injury or wrongful death are not subject to arbitration. Those claims, and any claim a court determines cannot be arbitrated, proceed in court under Section 13.7.
13.5 Class Action Waiver
YOU AND MINDFUL SOLUTIONS LLC EACH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of different parties except as provided in Section 13.6. If this class waiver is held unenforceable as to a particular claim, that claim (and only that claim) proceeds in court under Section 13.7.
13.6 Coordinated Filings
If 25 or more demands for arbitration are filed that raise similar claims and are brought by or with the assistance of coordinated counsel, then as a precondition to arbitration: (a) each demand must include an individualized statement of the claimant's facts, use of the Services, and alleged harm; (b) counsel filing each demand must affirm that its contents are accurate and that counsel has complied with the requirements of Federal Rule of Civil Procedure 11(b) or its state equivalent; (c) the parties will follow the AAA's mass-arbitration procedures, including the appointment of a process arbitrator; and (d) the arbitrations will proceed in staged sets of bellwether cases selected by the parties in equal numbers, with remaining cases held in abeyance (and any limitation periods tolled) until each stage concludes. The Section 13.2 informal-resolution step applies to every demand individually.
13.7 Court Proceedings and Jury Waiver
Any claim that is not arbitrated under this Section 13 will be brought exclusively in the state or federal courts located in Clinton County, Michigan, and you and we each consent to their jurisdiction, unless applicable law requires otherwise. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND MINDFUL SOLUTIONS LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY SUCH PROCEEDING.
13.8 Arbitration Opt-Out
You may opt out of Sections 13.3, 13.5, and 13.6 by emailing support@mindfulsolutionsllc.ai within 30 days of first accepting these Terms, stating your name, the email address on your account, and that you opt out of arbitration. Opting out does not affect any other part of these Terms, including Section 13.7.
14. Apple App Store Terms
If you obtained the App through the Apple App Store, the following apply: these Terms are between you and Mindful Solutions LLC only, not with Apple Inc., and Mindful Solutions LLC, not Apple, is solely responsible for the App and its content. Apple has no obligation to furnish any maintenance or support for the App. If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, consumer protection claims, and intellectual-property claims. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. General
15.1 Severability
If any provision of these Terms is held invalid or unenforceable, that provision is limited or severed to the minimum extent necessary, and the remaining provisions continue in full force. This applies with particular force within Sections 10 and 13: the invalidity of any one clause does not affect the others.
15.2 Entire Agreement
These Terms, together with the Privacy Policy and any policies they reference, are the entire agreement between you and Mindful Solutions LLC regarding the Services and supersede any prior agreements on that subject.
15.3 Assignment
You may not assign or transfer these Terms or your account. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
15.4 Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages of cloud, AI, or platform providers.
15.5 No Waiver; Survival
Our failure to enforce a provision is not a waiver of it. Sections that by their nature should survive termination do survive, including Sections 5, 8, 10, 11, 13, and this Section 15.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and post the updated Terms at this page. Your continued use of the Services after changes become effective constitutes acceptance.
If a change is material, we will ask you to accept the updated Terms in the App before continuing to use the Services, and we will record that acceptance as described in Section 1.
